RURAL MUNICIPALITY OF CORNWALLIS Minutes of a Special Meeting of Council held in the Council Chambers of the Municipality on Tuesday, November 4, 2008. PRESENT: Reeve Reg Atkinson Councillor Emil Egert, Ward One Councillor Bob Brown, Ward Two Councillor Sam Hofer, Ward Three Councillor Heather Dalgleish, Ward Four Councillor Mike Cranford, Ward Five Councillor Valerie Thoman, Ward Six ADMINISTRATION: Chief Administrative Officer, Bob Wallis CALL TO ORDER The meeting was called to Order at 7:00 P.M. Hladky Holdings Development Agreement Amendment Egert/Dalgleish That item 13 d of the Draft Development Agreement be amended to include the words "must be current" at the end of the sentence. Carried 7-0 Amendment Dalgleish/Egert That the Draft Development Agreement be amended to include the following: "That the developer obtain an agreement with the City of Brandon to accept septic waste from all 35 lots in the development and that the agreement be registered on each title." Defeated 5-2 In favour: Thoman, Dalgleish Opposed: Egert, Brown, Hofer, Cranford, Atkinson Amendment Thoman/Dalgleish That the Municipality receive plans from the developers Engineer for the Municipality's Engineer to review before the Municipality signs the Agreement. Defeated 4-3 In favour: Thoman, Dalgleish, Cranford Opposed: Egert, Brown, Hofer, Atkinson Resolution No. 378/2008 Hofer/Brown Be it resolved that the Municipality's signing officers be hereby authorized to enter into an Agreement with the owners of property generally described as Parcel A, Plan 1279 and being Part of the NE ¼ 27-10-18 WPM for the development of the lands in accordance with the terms included in a draft agreement prepared by McCandless Tramley and presented to Council this date subject to such minor modifications as the Municipality's legal counsel may deem necessary. Carried - As Amended In favour: Egert, Brown, Hofer, Cranford Opposed: Dalgleish, Thoman Brandon Annexation Proposal Resolution No. 379/2008 Thoman/Cranford Whereas on April 15, 2008, the Council of the R.M. of Cornwallis accepted an invitation to meet with the City of (Brandon) to discuss an annexation proposal by Brandon provided that a quorum of each Council attended the initial meeting; and Whereas Brandon prefers a smaller meeting structure and proposes to send two administrative and three elected officials to an initial meeting; and Whereas upon review Cornwallis is satisfied with the meeting structure proposed by Brandon; Now therefore be it resolved that the following be delegated to represent Cornwallis at meetings with Brandon to discuss Brandon's annexation proposal: Reeve Atkinson, Councillor Brown and Councillor Egert and Councillor Dalgleish as alternate. Carried 7-0 Transportation - Public Works Employee, Report The Municipality's Senior Operator, Pete van Lankvelt and Public Works Employee Blaine Wakefield attended. Resolution No. 380/2008 Thoman/Dalgleish Be it resolved that the Council adjourn to convene in camera as the Committee of the Whole of Council in order to discuss a personnel matter. Carried 7-0 Resolution No. 381/2008 Thoman/Dalgleish Be it resolved that the Council reconvene in regular open session; and Be it further resolved that all matters discussed while in camera remain confidential. Carried 7-0 While in camera the Committee of the Whole of Council discussed personnel matters. ADJOURNMENT Resolution No. 382/2008 Be it resolved that this meeting be adjourned.
